Jay, there's enough there for a jury if they believe the states case to convict. The law does not require an absolute air-proof air-tight case. Strictly as a matter of the law the state has met their legal burden of proof to survive a directed motion of acquittal. That is the only thing that is not open to debate under any circumstances. The California Supreme Court has extremely strict circumstances under which a directed verdict can be granted. I expect when that motion is made for Goodman to immediately dismiss that motion. I will detest this judge with every fiber of my being if he takes more than two minutes to reject the motion that will be made by Dubois. The California Supreme Court has repeatedly upheld no-body cases with slim circumstantial evidence and they demand extremely strict expediency in judicial rulings. The next couple of days will determine the competence of this judge in complying with Supreme Court mandate. If Dubois makes his motion to dismiss and Goodman declares that he needs time to consider the motion I will never forgive him because the state supreme court frowns upon that kind of garbage. Judges at all times are strictly bound by supreme court law and are never allowed to impose their own judgment.
